Under NZ law, you have the right to be placed back in the same position you were in prior to the accident. That is the legal principle, and it means far more than most drivers realise.

It means the at-fault driver is liable for every reasonable loss your negligence caused you. That includes the cost of repairing your vehicle, your transport costs while it is being repaired, and any other out-of-pocket losses that flow directly from the crash.

You are not relying on your own insurer's goodwill. You are not hoping the other driver's insurer agrees to help. You are asserting a legal entitlement that exists independently of any insurance policy.

Your Key Rights as a Not-At-Fault Driver in NZ

The right to a like-for-like replacement vehicle. You are entitled to a replacement vehicle that matches what you normally drive while your car is off the road. Not a basic economy car. Not whatever is convenient for the insurer. Like-for-like.

The right to choose your own provider. You do not have to accept the replacement vehicle your insurer or the at-fault insurer offers. The right to recover all reasonable costs. Repair costs, replacement vehicle hire, and other legitimate losses are all recoverable from the at-fault party's insurer. You should not be out of pocket.

The right to escalate if the insurer delays or refuses. If the at-fault insurer delays payment, disputes liability unreasonably, or low-balls your claim, you can escalate to the Insurance and Financial Services Ombudsman (IFSO). You have formal dispute resolution options.

What to Do Immediately After a Not-At-Fault Accident
